These Terms of Service ("Terms") govern your use of the Analytics web analytics platform. By using our service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using Analytics, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the Terms, you may not use our service.

2. Description of Service

Analytics provides privacy-friendly web analytics services that allow you to track and analyze website traffic. Our service includes:

  • Cookieless visitor tracking
  • Analytics dashboard and reports
  • Goal and event tracking
  • API access
  • Customer support

3. Account Registration

3.1 Account Requirements

To use Analytics, you must:

  • Be at least 16 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your account information

3.2 Account Responsibility

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

4. Acceptable Use

4.1 Permitted Use

You may use Analytics to track legitimate website traffic on websites you own or have authorization to track.

4.2 Prohibited Use

You may not:

  • Track websites you don't own without authorization
  • Use the service for illegal activities
  • Attempt to circumvent service limitations
  • Reverse engineer or copy the service
  • Use automated means to generate fake traffic
  • Resell or redistribute the service without permission
  • Interfere with or disrupt the service
  • Collect personal data from website visitors in violation of privacy laws

5. Payment and Billing

5.1 Subscription Plans

PureStats offers various subscription plans with different features and limits. Pricing is available on our Pricing page.

5.2 Billing

Subscription fees are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees incurred.

5.3 Open Beta

During the Open Beta period, all features and plans are completely FREE. No credit card is required. We will notify all users well in advance before transitioning to paid plans. Early adopters will receive special lifetime discounts as a thank you for helping us improve the platform.

5.4 Future Pricing

When we transition from Open Beta to paid plans, all users will be notified at least 30 days in advance. You will have the option to choose a plan that fits your needs or export your data and discontinue use of the service.

5.5 Price Changes

We may change our pricing with 30 days' notice. Price changes won't affect your current billing cycle.

6. Data Ownership and Usage

6.1 Your Data

You retain all rights to your analytics data. We don't sell, share or use your data for any purpose other than providing the service.

6.2 Data Retention

Analytics data is retained according to your plan's retention period. You can export or delete your data at any time.

6.3 Account Termination

Upon account termination, your data will be deleted within 30 days unless you request earlier deletion.

7. Service Availability

7.1 Uptime

We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We'll notify you of planned maintenance when possible.

7.2 Service Modifications

We may modify, suspend or discontinue any part of the service at any time with reasonable notice.

8. Intellectual Property

The Analytics platform, including all software, designs, text, graphics and other content, is owned by Analytics and protected by copyright, trademark and other intellectual property laws.

9. Privacy and Security

Our Privacy Policy explains how we handle your data. By using PureStats, you agree to our Privacy Policy.

We implement reasonable security measures to protect your data, but no method of transmission over the Internet is 100% secure.

10. Limitation of Liability

To the maximum extent permitted by law, Analytics shall not be liable for any indirect, incidental, special, consequential or punitive damages or any loss of profits or revenues, whether incurred directly or indirectly.

Our total liability shall not exceed the amount you paid to Analytics in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold Analytics harmless from any claims, damages, losses, liabilities and expenses arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of applicable laws

12. Termination

12.1 Your Right to Terminate

You may cancel your subscription at any time from your account settings. Your account will remain active until the end of your current billing period.

12.2 Our Right to Terminate

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activities
  • Fail to pay fees when due
  • Abuse or misuse the service

12.3 Effect of Termination

Upon termination, your right to use the service will cease immediately. Your data will be deleted within 30 days.

13. Dispute Resolution

Any disputes arising from these Terms or your use of Analytics shall be governed by the laws of Germany. You agree to submit to the exclusive jurisdiction of the courts in Berlin, Germany.

14. Changes to Terms

We may update these Terms from time to time. We'll notify you of significant changes via email or a notice in your dashboard. Continued use of the service after changes constitutes acceptance of the updated Terms.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Analytics.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.
